1. Acceptance of Terms
By accessing or using any service, platform, software, communication system, or technology product offered by XtreamData LLC (“XtreamData,” “we,” “us,” “our”), you (“Client,” “User,” “You”) expressly agree to be bound by these Terms and Conditions, our Privacy Policy, and any applicable Service Agreements or Statements of Work (collectively, the “Agreement”).
If you do not agree to these terms, do not access, use, or engage with any XtreamData service.
These Terms apply globally, irrespective of geographic location, nationality, or jurisdiction.
2. Services Covered
This Agreement applies to all services provided by XtreamData, including but not limited to:
- IT Infrastructure Design and Support
- Hardware Procurement and Setup
- Software Deployment, Licensing & Customization
- SMS/Text Messaging Marketing Systems
- Network Administration and Cybersecurity
- Web Development, Hosting, and SEO
- Business Automation, CRM/ERP Integration
- Remote Diagnostics and Technical Support
3. User Responsibilities
You agree to:
- Provide accurate and lawful information.
- Use XtreamData services only for lawful purposes.
- Not interfere with or abuse any XtreamData system.
- Comply with all local, state, federal, and international laws applicable to your use.
- Refrain from reverse engineering, copying, reselling, or misusing any of our proprietary tools or systems.
- Maintain the confidentiality of any XtreamData login credentials, access points, or IP-sensitive integrations.
You are solely responsible for the consequences of any misuse, unauthorized access, or negligent security practices related to your environment or account.
4. Fees and Payments
All services are billed according to the terms outlined in your Service Agreement, quote, invoice, or subscription plan.
- All fees are due upon receipt unless otherwise stated in writing.
- Late payments may result in service suspension or termination.
- Returned payments or chargebacks will incur administrative and legal fees.
- XtreamData reserves the right to modify pricing with 30-day advance notice.
If you dispute a charge, you must notify XtreamData in writing within 7 days of the invoice date.
5. Intellectual Property
All content, designs, code, platforms, integrations, logos, and software developed or provided by XtreamData remain our exclusive intellectual property, unless expressly transferred in a signed agreement.
- You may not use XtreamData’s trademarks, logos, or brand assets without written permission.
- Any custom code, plugins, automations, or integrations built for you by XtreamData may be licensed but not owned, unless otherwise agreed.
6. Messaging & SMS Communications
XtreamData may send you SMS or text messages related to service updates, billing, support, and marketing.
- Consent: You agree to receive these communications by providing your number through forms, service usage, or contract.
- Opt-Out: You may reply “STOP” to any promotional text or contact us directly at (877) 818-7800.
- Message/data rates may apply. Message frequency may vary.
Some system-critical messages may be exempt from opt-out under legal and service-related obligations.
7. Termination
XtreamData reserves the right to suspend or terminate your access to services at any time for:
- Violation of these Terms
- Non-payment or charge disputes
- Abuse of systems or personnel
- Suspected fraud, illegal use, or breach of security
No refunds shall be issued in the case of termination for cause.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, XTREAMDATA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our liability, under any circumstance, shall never exceed the total amount paid by you for the services in question during the prior 60 days.
9. No Warranty
XtreamData provides all services “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied. This includes but is not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
10. Confidentiality & Data Protection
XtreamData follows strict security protocols. However, you acknowledge that no system is immune to intrusion or failure. We disclaim responsibility for:
- Third-party breaches
- Customer-side security failures
- Data loss due to non-cooperation or refusal to follow professional recommendations
Data processed by XtreamData is subject to our Privacy Policy and applicable data protection laws (GDPR, CCPA, etc.).
11. Dispute Resolution
- Governing Law: These Terms shall be governed by the laws of the State of South Carolina, USA.
- Disputes: Parties agree to first attempt informal resolution. Failing that, binding arbitration will be pursued in South Carolina under AAA Rules.
- Waiver of Class Actions: You waive any right to join a class action against XtreamData.
12. Modifications
XtreamData may amend these Terms at any time. Updates will be posted to our website and/or communicated directly. Your continued use of services after changes are posted constitutes acceptance.

XtreamData SMS Messaging Terms and Conditions

By opting in to receive SMS messages from XtreamData LLC (“XtreamData,” “we,” “us,” “our”), you agree to the following legally binding Terms and Conditions (“Terms”).
1. SMS Messaging Service
By providing your phone number, you consent to receive SMS text messages from XtreamData for appointment reminders, service alerts, product updates, marketing messages, and general two-way communication related to information technology consulting, software development, telecom services, CRM/ERP automation, and home automation support.
Message and data rates may apply.
2. Message Frequency
You may receive up to 6 messages per month unless you opt out. Message frequency may vary based on service activity and engagement level. XtreamData reserves the right to modify the number or timing of messages at any time.
XtreamData and mobile carriers are not responsible for delays, delivery failures, or undelivered messages.
3. Message and Data Rates
Standard message and data rates may apply in accordance with your mobile carrier’s pricing plan. Please consult your carrier for details.
4. Privacy Policy
Your information will be managed in accordance with our strict global Privacy Policy. We do not sell or lease your data to third parties. All data handling complies with U.S. law, GDPR, CCPA, and industry best practices.
5. Cancellation / Opt-Out Instructions
